Abstract
There are increasing demands for a foundational right to life and health and they are becoming expanded to a right to death. What kind of treatment would be offered, when it would be interrupted, not treating might be better than treating; those are the real questions that patients should be involved. In care of elderly patients, autonomy related to decision making is more frequently problematic in Korea. Lack of financial power, neglect by their offspring and sometimes patients’incompetence are not uncommon in elder patients. Ethical and legal issues of the elderly lead to some of the most challenging situations for physician. Here the current legal issues in the care of elder patients is described and the possible solutions to those problems are discussed with review of literature.
